MASTER SERVICE AGREEMENT (MSA)

Latar Belakang



14 Februari 2013 Kumpulan IKRAM Sdn. Bhd (KISB) telah membuat permohonan kepada kerajaan Malaysia melalui Kementerian Kewangan untuk dilantik sebagai panel pakar dalam bidang Kejuruteraan Geoteknik terutama bahagian cerun.

27 November 2014 Surat dari Kementerian Kewangan bertarikh 27 November 2014 kepada Ketua Setiausaha Kementerian Kerja Raya menyatakan kelulusan permohonan KISB sebagai pakar kepada Kerajaan Malaysia bagi Perkhidmatan Kejuruteraan Forensik (cerun dan srtuktur berkaitan cerun)


Dalam surat tersebut pihak kerajaan telah menetapkan beberapa syarat dan meminta KISB menyediakan Master Service Agreement (MSA) yang akan disemak oleh JKR dan Kementerian Kerja Raya


KISB bersama dengan JKR Cawangan Cerun dan Kementerian Kerja Raya telah bersama-sama menyediakan MSA untuk semakan Bahagian Undang-undang KKR dan dimuktamadkan oleh Kementerian Kewangan Malaysia.


10 Disember 2015 Surat Kementerian Kewangan bertarikh 10 Disember 2015 kepada Ketua Setiausaha Kementerian Kerja Raya telah meluluskan Master Service Agreement tersebut dan kontrak kepada KISB bagi perkhidmatan Kejuruteraan Forensik (cerun dan struktur berkaitan cerun) bermula dari 1hb Januari 2016.


Tempoh kontrak adalah selama 3 tahun dengan lanjutan selama 2 tahun tertakluk kepada prestasi baik.

29 Disember 2015 Master Service Agreement telah ditandatangani oleh Ketua Setiausaha Kementerian Kerja Raya (mewakili Kerajaan Malaysia) dan Pengerusi Kumpulan IKRAM Sdn. Bhd (mewakili KISB).

INTRODUCTION


TECHNICAL DEFINITIONS

'Forensic Engineering & Failures' has the meaning which include, without limitation:-

Forensic Engineering means the engineering investigation of the causes of failures (materials, products, workmanships and design) of slopes and structures. The investigation will benchmark against existing codes, standards, statutory/regulatory requirements and best practices in the construction industry; and

Failure means the ultimate manifestation of distress, resulting in an unacceptable difference between expected and observed performance. Failure can also mean the termination of the ability of a component or system to perform an intended or required function. Not all failures are catastrophic; most involve components that simply do not perform as expected.


THE SCOPE OF SERVICES


The Forensic Engineering Services (Slopes & Slope Related Structures), including Site Supervision of Construction Works as follows:

Slopes;

Slope related (associated and affected) structures; and

Related services inclusive of field & laboratory testing which are needed solely for the Forensic Engineering Services (Slopes ∓ Slope Related Structures).

Any physical works (construction) are outside the scope of this Agreement.


TECHNICAL DEFINITIONS


'Slope Associated Structures' means any or all structural components which form(s) an integral part of the Slope and contribute(s) towards(s) its stability including but without limitation to soil nail, retaining wall, reinforced earth wall, rubble wall, etc; and

'Slope Affected Structures' means any or all structures located in the vicinity of the Slope and is/ are affected by the Failure.
